LA judge dismisses suit over park Nativity scenes

LOS ANGELES (AP) ? A Los Angeles federal judge on Thursday dismissed a Christian group's lawsuit to force suburban Santa Monica to reopen spaces in a city park to private displays, including Christmas Nativity scenes.

U.S. District Court Judge Audrey Collins issued the ruling after earlier this month denying an injunction sought by the Santa Monica Nativity Scenes Committee.

Christmastime Nativity scenes had been erected in Palisades Park for decades. Last year, atheists overwhelmed the city's auction process for display sites, winning 18 of 21 slots and triggering a bitter dispute.

The city then banned private, unattended displays at the park.

An attorney for the group says he plans to appeal the ruling.

Collins had said the city was within its constitutional right to eliminate the exemption that had allowed the Nativity at the oceanfront Palisades Park because the change affected all comers ? from Christians to Jews to atheists ? and provided other avenues for public religious speech.

The coalition of churches that had put on the life-sized, 14-booth Nativity display for decades argued the city banned it rather than referee a religious dispute that began three years ago when atheists first set up their message alongside the Christmas diorama.

In her ruling Thursday, Collins said the coalition has other options.

"For instance, plaintiff could erect displays in some public parks around the city (excluding Palisades Park) as part of a one-day community events permit, or plaintiff could erect attended displays in all of the city's public parks," Collins wrote in her 25-page ruling. "Plaintiff raises several arguments to suggest that these alternatives are not adequate, but none is persuasive."

The trouble in Santa Monica began three years ago, when atheist Damon Vix was granted a booth in Palisades Park alongside the story of Jesus Christ's birth.

Vix hung a sign that quoted Thomas Jefferson: "Religions are all alike -- founded on fables and mythologies." The other side read "Happy Solstice." He repeated the display the following year but then upped the stakes significantly.

Vix recruited 10 others last year to inundate the city with applications for displays and the atheists used half their spaces, displaying signs such as one that showed pictures of Poseidon, Jesus, Santa Claus and the devil.

Most of the signs were vandalized and in response the city ended a tradition that began in 1953 and earned Santa Monica one of its nicknames, the City of the Christmas Story.

Childhood obesity rates have tripled in the past 30 years, and about one in three kids is overweight or obese. Now by answering six simple questions you may be able to predict if it will happen to your child.

Traci Glazner?s 5-month-old daughter Faye has been long and lean since birth.

?When Faye was born she was 19 and a half inches and weighed 6 pounds, 3 ounces,? said Traci.

Experts say birth weight is one factor that can predict whether a baby becomes obese later in life.

Now researchers in England have developed a simple formula that can determine which newborns are most at risk.

It also includes the body mass index of the parents, the number of people in the household, the mother?s professional status, and whether she smoked during pregnancy.

?That calculation would have an 80 percent chance of being right so it really does a good job. It is an important tool,? said Dr. Jonathan Fanaroff, a pediatrician.

More than a third of children and teens in the U.S. are overweight or obese. Doctors say once a child gains weight, it?s difficult for them to lose it, so prevention from the earliest age is key.

?Maybe this calculator will get some families who might otherwise not take a healthy lifestyle seriously to take it more seriously,? said Dr. Fanaroff.

Traci already does something very important that can help prevent child obesity.

?I nurse Faye 100%. She hasn?t started any solid food yet, so all she?s had is breast milk,? said Traci.

The researchers did their original study on 4,000 children from Finland. But they say the formula also proved accurate in studies in the United States.

Stocks rise and fall with twists in budget talks

NEW YORK (AP) ? Optimism that a budget deal will be reached in Washington sent stocks modestly higher Thursday. A pair of economic reports also brightened the mood.

The Dow Jones industrial average rose 36.71 points to close at 13,021.82.

The stock market took a brief turn lower when House Speaker John Boehner said little progress was being made in budget talks in Washington. The Dow was up as much as 77 points in morning trading, turned negative as Boehner made his remarks at 11:30 a.m., then slowly recovered in the afternoon.

Investors were encouraged by several positive economic reports, including a higher estimate of third-quarter U.S. economic growth, an increase in home sales and a drop in claims for unemployment benefits.

After a meeting with Treasury Secretary Tim Geithner, Boehner told reporters that Democrats still haven't said which cuts they would accept to government benefit programs, suggesting a final budget deal remains a long way off. Republicans have said that they are open to increasing tax revenues as part of an agreement but only if they're accompanied by significant cuts to spending.

Investors have been closely watching the talks between the White House and Congress over the "fiscal cliff", a reference to sharp government spending cuts and tax increases scheduled to start Jan. 1 unless a deal is reached to cut the budget deficit. New developments in the talks have whipsawed the market.

"It's a headline-watching market with this fiscal cliff," said David Brown, chief market strategist of the investment research firm Sabrient Systems.

Brown says the ongoing negotiations are likely to cause the stock market to take sudden turns in the weeks ahead. "But things seem to be moving in the right direction," Brown said. "I don't think either party wants to get pinned with hurting the market or the economy."

In other trading, the Standard & Poor's 500 rose 6.02 points to 1,415.95. The Nasdaq composite index gained 20.25 points to 3,012.03.

In the market for government bonds, the yield on the 10-year Treasury note slipped to 1.62 percent from 1.63 percent late Wednesday.

Stock in Guess gained 55 cents to $25.81 after the clothing maker joined the ranks of companies pledging special dividends to shareholders before favorable tax rates on dividends expire at the end of the year. The clothing company said it will make a one-time payment of $1.20 per share on top of its regular quarterly dividend of 20 cents.

Dividends, now taxed at 15 percent, will be treated like ordinary income next year unless Congress and the White House extend current tax breaks as part of a budget deal.

The Commerce Department raised its estimate for U.S. economic growth to an annual rate of 2.7 percent in the July-through-September period. That's much better than the 2 percent rate estimated a month ago and more than twice the 1.3 percent rate logged in the three previous months.

The Labor Department also reported that the number of Americans applying for unemployment benefits dropped to 393,000 last week, in line with what economists had expected. It was the second straight drop after Superstorm Sandy drove applications higher earlier this month.

Target, The Gap, and others retail stores posted poor sales numbers, driving their stocks lower. It's a crucial time for retailers, who log a huge chunk of their yearly profits in the weeks running up to the holidays.

Among other companies making news:

? Kohl's plunged 12 percent, the biggest drop in the S&P 500 index. The company posted a drop in sales and said stores in the Mid-Atlantic and the Northeast, areas hit by Superstorm Sandy, fared the worst. Kohl's stock lost $6.13 to $45.02.

? Kroger Co. rose $1.19 to $26.25 after the supermarket chain reported stronger quarterly profits and raised its earnings outlook for the year. Stronger sales helped the operator of Fred Meyer and Food 4 Less stores post better results than analysts had expected.

Generally if I'm spending a lot of time with someone it's either because they're new to me and I want to... consume them, in a way, and have them consume me; or it's because I'm feeling endlessly lonely and empty and I guess I'm trying to fill that emptiness, which probably has a huge emotional toll on the people whom I pass that burden onto. I never do it intentionally, though, the obsession and love I feel for the person is genuine, I flip between idealisation/devaluing so often and it's usually a rotation of existing friends anyway - I don't discard them for good when I'm 'done' with them.

Separatists winning in Catalonia, Spain - early results

BARCELONA, Spain (Reuters) - Four separatist parties in Spain's Catalonia looked set to win a majority in regional elections on Sunday, partial results showed, but the main one was on course to lose some seats, possibly undermining its bid to call an independence referendum.

With half of votes counted, the ruling Convergence and Union alliance, or CiU, was winning 48 seats in the 135-seat local parliament, well down from its current 62 seats.

The separatist Republican Left, or ERC, was winning 20 seats, with two other smaller separatist parties taking a total of 16 seats, giving the four parties 60 percent between them.

Regional President Artur Mas, of CiU, had campaigned on a pledge to hold a referendum on independence, in response to a resurgent separatist movement among Catalans who are frustrated with Spain in a deep economic crisis.

Opinion polls had forecast that CiU would retain 62 or more seats in the local Parliament and that all four separatist parties would have more than two-thirds of the seats. Neither of those projections was met as the results began to come in.

Without the psychological backing of a two-thirds majority, analysts have said, it may be hard for Mas to defy the constitution and the central government in Madrid and try to hold a referendum.

Turnout was very high in the election, 68 percent, 10 percentage point higher than in the previous vote two years ago.

With more people than Denmark and an economy almost as big as Portugal's, Catalonia has its own language. Like Basques, Catalans see themselves as distinct from the rest of Spain.

Growing Catalan separatism is a huge challenge for Prime Minister Mariano Rajoy, who is trying to bring down painfully high borrowing costs by persuading investors of Spain's fiscal and political stability.

Mas converted to separatism after huge street demonstrations in September.

Up until recently Mas was a moderate nationalist who had pushed Spain to give Catalonia more self-governing powers. He has followed the popular mood in converting to a more radical separatism, but it is not clear he can hold a referendum legally.

Many Catalans are angry that Rajoy has refused to negotiate a new tax deal with their largely self-governing region. Annually, an estimated 16 billion euros ($21 billion) in taxes paid in Catalonia, about 8 percent of its economic output, is not returned to the region.

Home to car factories and banks that generate one fifth of Spain's economic wealth, and birthplace of surrealist painter Salvador Dali and architect Antoni Gaudi, the region also has one of the world's most successful football clubs, FC Barcelona.

Serbia Democrats elect Belgrade mayor as new party leader

BELGRADE (Reuters) - Serbia's pro-Western Democratic Party elected mayor of Belgrade Dragan Djilas as its new leader on Sunday who pledged to reform the party following an election defeat in May.

Addressing a party congress, 45-year-old Djilas said the Democrats had to take their share of responsibility for unemployment, now over 25 percent, double-digit inflation and a public debt seen at 60 percent of gross domestic product (GDP) by the end of this year.

"The fact is that we are responsible ... as Serbia is facing hardships, many are unemployed, living standards are on the decline, inflation ... is on the rise," Djilas said

Djilas, a former journalist and businessman, won an overwhelming majority of votes from 3,200 delegates.

Boris Tadic stepped down a head of the party this month after losing the presidency in May, but will retain a ceremonial position of a honorary president of the party.

During his eight-year leadership of the party, Tadic helped Serbia improve relations with Croatia, Bosnia and Kosovo, its former foes from the wars of the 1990s and led the country to its European Union candidacy. But he failed to stem rampant corruption, nepotism, red tape and economic downturn.

After a drubbing in the May elections, the Democratic Party was forced into opposition by a coalition of the nationalist Serbian Progressive Party, the Socialist Party of Serbia previously led by late strong man Slobodan Milosevic, and the pro-business United Regions.

Tadic also narrowly lost presidential elections to Tomislav Nikolic, a nationalist and the former head of the Progressive Party.

Djilas pledged to lead the party towards a victory in the next general elections slated for 2016, but stressed the need for reforms within the party.

In recent weeks, the senior party members Oliver Dulic, former minister for environment and Sasa Dragin, former minister for agriculture, have been separately charged by prosecutors for fraud and abuse of office.

As you'll see in the video after the break, Larsen has already hit unofficial averages of 55.3 knots (63.7MPH) over a nautical mile, 59.4 knots (68.3MPH) over 500 meters and 64.8 knots (74.6MPH) in peak speed. If we could reach that kind of pace on the water, we'd start to look at everyday motorboats as downright antiquated.

"Now, I joke, but for the first time in our history, the winners of the White House Turkey Pardon were chosen through a highly competitive online vote," Mr. Obama said, referring to the White House Facebook vote on whether Cobbler or Gobbler would be designated the official bird. "And once again, Nate Silver completely nailed it. The guy is amazing. He predicted these guys would win."

The president also expressed his desire that "over this holiday weekend, we're also thinking about our extraordinary men and women overseas who are serving far away from home in harm's way. But the reason they're there is because they give thanks too for the extraordinary life that have here in the United States of America. So may God bless those brave men and women in uniform who are away from their families this holiday season. May God bless the American people. May you all have a very happy Thanksgiving." But even if the light-hearted event was replete with references to troops in harm's way, and allusions to the political season that just ended, the president was not willing to discuss the big news of the day. House panel: Let courts decide Fast and Furious

WASHINGTON (AP) ? A House panel said Wednesday it believes federal courts have the authority to decide a dispute in which Attorney General Eric Holder is refusing to provide Congress with Justice Department documents about a botched criminal investigation into gun-trafficking on the Southwest border.

In a 65-page filing about Operation Fast and Furious, the House Oversight and Government Reform Committee said federal courts have routinely reviewed the validity of congressional inquiries. The lawyers for the House said Holder's contention that courts cannot adjudicate political disputes would permanently shut the courthouse doors to virtually all disputes between the executive and legislative branches.

In court papers filed last month, the Justice Department said the courts must defer to the time-tested political process of stepping aside and letting Congress and the executive resolve their political differences.

"Labeling a dispute 'political' is not a legal argument; it is a talking point masquerading ? poorly ? as an argument," said the filing for the committee chaired by Rep. Darrell Issa, R-Calif. "Federal courts have been deciding cases regarding the executive's compliance with subpoenas since the earliest days of the Republic."

In the dispute over Operation Fast and Furious, President Barack Obama has invoked what is known as executive privilege. The Republican-run House in June voted Holder in contempt of Congress for refusing to turn over subpoenaed records that might explain what led the Justice Department to reverse course after initially denying that federal agents had used a controversial tactic called gun-walking in the failed law enforcement operation.

"It is no exaggeration to say that if the courthouse door is closed to Congress in subpoena enforcement cases of this nature, the executive's incentive to respond to congressional requests for information largely will disappear and, with it, effective congressional oversight of the executive branch," the House's court papers said.

In Fast and Furious, agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives abandoned the agency's usual practice of intercepting all weapons they believed to be illicitly purchased, often as soon as they were taken out of gun shops. Instead, the goal of the gun-walking approach was to track such weapons to high-level arms traffickers who long had eluded prosecution, and to dismantle their networks.

Federal agents lost track of many of the guns. The operation identified more than 2,000 illicitly purchased weapons, and some 1,400 of them have yet to be recovered.

Selenium then melted around those drops, which completely dissolved away, leaving a melted selenium ball with a hole in the middle. It turns out that those selenium "doughnuts" can be packed tightly onto a metal surface without touching, thanks to their soft shells, which could allow more bits to be packed onto a hard drive, or be used in quantum computers and next-gen displays. Since the dots are smaller than a living cell, it took the researchers an entire year to figure out what they'd made and how they did it -- luckily they didn't just bin the whole thing and start over.
