Instant View: Job growth strong again in February

(Reuters) - Employment grew solidly for a third straight month in February, a sign the economic recovery was broadening and in less need of further monetary stimulus from the Federal Reserve.

KEY POINTS:

* Employers added 227,000 jobs to their payrolls last month, the Labor Department said on Friday, while the unemployment rate held at a three-year low of 8.3 percent.

* It marked the first time since early 2011 that payrolls have grown by more than 200,000 for three months in a row - bolstering President Barack Obama's chances for re-election.

* The economy created 61,000 more jobs in December and January than previously thought, and the jobless rate held steady even as more people returned to the labor force.

COMMENTS:

ADAM BUTTON, CURRENCY ANALYST AT FOREXLIVE IN MONTREAL:

"This number confirms that U.S. employment continues on an upward trajectory, and it adds clout to those who are saying that QE3 is not the right option at this time. That said, there is some sentiment in the market that the unseasonably warm weather in February has skewed data across the board. We're seeing some U.S. dollar strength, and in stocks some further optimism about the economy, though that could be tempered by skepticism about weather-related effects."

STEWART HALL, SENIOR FX STRATEGIST, RBC CAPITAL MARKETS, TORONTO:

"Good numbers on both overall and private payrolls, and the icing on the cake are the fairly sizable upward revisions. Household job growth is still at relatively healthy levels and the climb in the participation rate is encouraging. It puts a floor under the unemployment rate but it's good to see people coming back into the workforce. For the market, it's still a bit of a Goldilocks scenario - the jobs number points to recovery but it's not so strong that it necessarily scotches quantitative easing, as you still can't characterize this job market as normal by any means."

CRAIG DISMUKE, CHIEF ECONOMIC STRATEGIST, VINING SPARKS, MEMPHIS, TENNESSEE:

"This is a healthy number. It confirms that the labor market is gradually improving. I also liked the revisions. All in all, it's really a positive report.

"The participation rate rose 0.2 percent which is the biggest monthly increase in two years. That's another positive sign. But there are still fundamental weakness in the labor market. Still the jobs market is showing steady improvement.

"It is a good enough number that you will see this would give some strength in stocks and some weakness in bonds.

"The last three months in payrolls in combination have likely delayed the Fed's implementation of QE3."

OMER ESINER, CHIEF MARKET ANALYST, COMMONWEALTH FOREIGN EXCHANGE WASHINGTON, D.C.

"It looks like a solid number pretty much across the board. We got a better-than-consensus reading for the headline number and there were some whisper numbers that were well below the 200,000 mark, so that's even better news than the better-than-expected number might suggest. I think we'll begin to spark debate about the Fed exiting its ultra-accommodative policy stance sooner than expected. I think if this trend continues then clearly there'll be a translation of good economic news to the outlook for Fed policy. I think that's going to be dollar supportive."

SEAN INCREMONA, ECONOMIST, 4CAST LTD, NEW YORK:

"This continues to show that job growth is going at an encouraging pace. Upward revisions to the previous month and a solid February keeps that positive sentiment alive. I don't really think this is a game-changing figure in itself, I think we are still in a moderate recovery and that we can continue job gains around this level, but it may be difficult to continue to gather momentum."

VIMOMBI NSHOM, ECONOMIST, IFR ECONOMICS, A UNIT OF THOMSON REUTERS:

"The employment picture in February was just as encouraging as January's surprise, with 227k jobs added to the economy in February. While the payrolls measure beat market expectations which thought payroll growth would slow to 210k, an unchanged unemployment rate of 8.3% in February matches forecasts predicting that entrants to the labor force would limit the percentage of employed, and thus hold the unemployment rate for the second month. Payrolls have risen by over 200k for the third straight month, making room for more analyses that the economic recovery is about to perform on its own (without government support) as more jobs bring about more demand and disposable income to perpetuate its own growth.

"Revisions added an additional 61k jobs to the labor market as January had 284k jobs(originally 243k) and December was revised up from 203k to 223k jobs. January's private payroll growth (now 285k from 257k)essentially represents January's labor market as government job losses were revised down to a decline of 1k from 14k. January services account for majority of the revision (from 149k to 202k) with nearly every industry revised higher, especially healthcare (from 29.7k to 43k), temp help (up 12k to 32.1k), and retail (up to 26.1k from 10.5k)."

Column: Messi-ah or just Messi? Doesn't matter

PARIS (AP) -Two months ago, Pele was asked the same question many people are asking again now: Is Lionel Messi better than you were?

"Difficult to say," the great man replied. "When Messi has scored 1,283 goals like me, when he has won three World Cups, we can talk about it again."

There are two ways to understand that answer.

One, of course, is 'No.' His latest record-setting five-goal feat in the Champions League notwithstanding, Messi still cannot definitively be called the greatest footballer of all time. Perhaps no one can.

But the other and more diplomatic point Pele possibly was trying to make is that, unlike the Brazilian, Messi is still an art work in progress. He has not finished sculpting his place in football history. Not even close. Messi, greatest ever? Why are we discussing this now? Come back and see me in 10 years.

Also, pitting one generation against another is often treacherous, even pointless.

Rod Laver played with a small wooden racket; Roger Federer has a big graphite one. So how can those tennis legends be compared, given that the sport Federer plays bears only a passing resemblance to the one Laver knew?

Likewise, football is faster, more commercial, more all-consuming and more of a science than it was in the day of Pele and Maradona.

Today's billiard-table pitches provide Messi with a better canvas than Pele and Maradona sometimes had on which to display his array of talents.

Possibly, the Argentine also has it easier than them because he's better protected when he plays. Referees today are more alert to and intolerant of the brutal tackles that Maradona was subjected to by opponents overwhelmed by his weaving speed and guile. All these years later, video of Andoni Goikoetxea's infamous ankle-smasher from behind in 1983 that cast an ill-wind over Maradona's spell at Barcelona still makes the blood run cold.

So, again, can Messi, Maradona and Pele really be compared, given their different eras? Perhaps the only certainty is that they can't.

As Pele told French newspaper Le Monde in January, the day after Messi became the first to win FIFA player of the year three times in a row: "There is no need to compare. Football changes."

Still, that won't stop Messi fans from placing him at the top of the 'best-ever' pile every time he does something remarkable - which, admittedly, does seem to be almost every time he runs onto the field.

"He is the best player in football's history and we've never seen anyone like him" was his teammate Cesc Fabregas' verdict after Messi put five - yes, five - goals past Bayer Leverkusen on Wednesday night.

The last player to score five in European football's top club competition was Soren Lerby of Ajax against Omonia in 1979. Messi is the first to do it since the European Cup was re-branded the Champions League in 1992.

"One day he'll score six," said Barcelona coach Pep Guardiola.

That's not hard to believe.

But, objectively, all that Messi has achieved at this point in his career is the right to be mentioned in the same breath as Pele and Maradona - or Maradona and Pele, the order depending on which of those two you consider to be the best.

The World Cup remains a big black hole on Messi's CV.

"When he plays with Argentina, he doesn't have the same success," Pele noted. "People are always asking me, 'When will there be a new Pele?' Never! My father and mother shut down the production line."

But with each new record, each additional trophy he wins with Barcelona, the stronger the argument for Messi becomes.

All being well, Messi will this month or next become the first player to score more than 12 Champions League goals in a single season. He will also soon net the eight goals he needs to become the all-time record scorer in Barcelona's illustrious 113-year history. Cesar Rodriguez, at least for a few more weeks, now holds that club record with his 235 goals in official matches from 1942-55.

And Messi is still only 24. If he carries on at this rate for another five or even 10 years, the Messi, Maradona or Pele debate maybe will have a clear winner.

"When he finishes his career he may be the considered the best ever," said Barcelona midfielder Xavi Hernandez.

Given the competition from Pele and Maradona, however, that is still a big 'if.'

The simplest and fairest solution is this: Accept that, for each era, there is a footballer who towers above the rest. Pele, Maradona, Zinedine Zidane and now, unquestionably, Messi.

But we don't need to compare Messi against those other players to understand a blindingly simple truth: The way he plays football, his humble and inventive genius, is an absolute delight to behold.

How lucky we are to live in his time.

But fans in Pele and Maradona's eras felt that way, too.

What Are the Legal Implications of Too Much Perfume at Work? And ...

Lynda: What is the proper way to handle the situation when a co-worker wears too heavily perfume in the workplace and it is affecting other co-workers? Is there any legal complications if we were to request them to not wear perfume?

Joe Escalante: This varies by state because some states or regions, like Santa Cruz California, have actually attempted to pass laws protecting employees from certiain forms of discrimination, like agains the ?ugly.?
However, there are competing rights because many have perfume allergies. I would frame this in a ?employee?s right to be free from allergy causing chemicals? rather than saying something like ?yo body stank.?
If a person decides to sue their employer over this, the allergy defense would be the best one. So start with that. Basically you tell the person that the establishment might get sued by these allergic employees, so please do us a favor, and cut back on the sauce.

Patricia: Good Morning Joe, I have wrote to you before i am going threw a divorce been separated since October and can not afford an attorney have a child to care for and i am on unemployment got separation and settlement papers they are so unreasonable i cant sign sent a paper to his lawyer saying i did not agree and would not sign sent it cert. mail. Joe Escalante: Court works like this. The opposition files something. You file an answer. You present your best case for your position. You submit evidence supporting it. In this case, the main evidence seems to be your low income, and high expenses. You have to do all the math and present it to the judge. The main issue here is what is in the best interest of the child. How much does the child to prosper in terms of time with parents and financial support.
It?s really not as complicated as it seems, but without a lawyer, there are a lot of things that can go wrong. Get this book by Nolo press right away and read it. Keep searching the internet for other legal help. You are what is called a ?pro se? litigant, meaning without an attorney. This word helps when googling for information. Joe Escalante: I am unaware of any time litmitations with respect to QDROs but they are not retroactive. You can only get prospetive benefits so it?s in the interest of beneficiary to get it done as soon as possible.

Joe Escalante: Sounds like good old fashioned Texas Shenanigans. No one can force you to buy a car bundled with financing and a warranty, and no one can prevent them from offering bundled products, but their advertising practices might put them in violation of state and federal consumer protection regulations.

Stashia: My husbands baby mama has a restraining order against him for terristic threats which he is currently on probation for and since this court orde?r they had twi children together are these kids a violation of his probation and how can he exercise his rights to see these kids and get atleast joint custody of theses kids without going to jail/violating probation

Joe Escalante: The first thing he would do is petition for a court order for supervision rights to visit the twins. However, he must reveal the restraining order info. At that point it will be up to the court to decide if it is in the best interest of the twins to be visited by a guy with this kind of criminal record and restraining order, etc.

Betsy: If a sister is listed as the ?agent? on a Medical Power of Attorney & HIPPA Relesase Authorization form, and the other 2 sisters are listed as 1st and 2nd Alternate Agents, does this mean that the 2 Alternate Agents will not be able to obtain any health information about the patient? I believe it also means that the ?agent? sister does not have to consult the other 2 on any decisions. Am I correct in all of the above?

Joe Escalante: You are correct. This is not a committee. The alternates are nothing until needed to take the place of the 1st choice, in the event she could not exercise the duties. Until then, they have no extra rights or privileges to info just because they are alternates.

Joe Escalante: Well, let?s start with a legalzoom DBA? That?s always fun. But seriously you will need one, that?s key to you getting you business bank account. You will need a seller?s permit from your state, that?s how they keep track of sales tax. You may need a business license from your city, county, or state as well.
But most of all, you need a good tax advisor. Get one now. Also, get some liability insurance. Michael: I see that many times police officers park their car in the center medium at an intersection looking for violators of Title 75. Yet Title 75 says that the only time an officer himself can violate the law is in pursuit of a suspected criminal, or for the purpose of investigations. Clearly, the officer who is handing out citations is no longer investigating, but acting on collusions based on his investigating. Elyssa: Are there benefits to having a business ID from the IRS vs. being a sole proprietor and using your own SS#?

Joe Escalante: Benefits usually stem from being a corp or LLC. Mainly, people are trying to protect personal assets from lawsuits or debts incurred by the company. There are tax advantages as well. However, if you are not ready to become one of these entities, a sole proprieorship with insurance is almost as good, at least in terms of liability. For the tax advantages, talk to your tax pro.

Joellyn: My husband and I, ages 71 and 62 respectively, have not yet made a will. We own our home, and have a few other assets, but we would like to know if a simple will is the right way to go, or a living trust, or a living will? We want the simplest, least complicated, least expensive way to transfer our assets on to each other in the case of our deaths. Thanks!

Joe Escalante: To transfer assets to eachother, the simplest way is to just make sure the title to the property is held in a manor where it automatically transfers to the other spouse upon the death of the other, as in ?joint tenancy with right of survivorship.?

Next, make sure your bank accounts are the ?payable upon death? variety. That will take a lot of stuff out of the probate process.

However, if you place the house in a living trust, it will avoid probate even if you both die simultaneously in an accident or something. A living will is just a medical derective for end of life issues.

Jeffrey: Joe; If you do not threaten or use foul language, is it legal to challenge someone to a fight via social media? THX

Joe Escalante: Fisticuffs? It sounds quite honorable to me. However, as soon as you land a blow, the big baby might sue you for damages or have you arrested for assault. And gentlemen should always adhere to the Marquess Of Queensberry rules of pugilistic competition, some of which are listed below:

1. To be a fair stand-up boxing match in a 24-foot ring, or as near that size as practicable.
2. No wrestling or hugging (clinching) allowed.
3, The rounds to be of three minutes duration, and one minute?s time between rounds.
4. If either man falls through weakness or otherwise, he must get up unassisted, 10 seconds to be allowed him to do so, the other man meanwhile to return to his corner, and when the fallen man is on his legs the round is to be resumed and continued until the three minutes have expired. If one man fails to come to the scratch in the 10 seconds allowed, it shall be in the power of the referee to give his award in favour of the other man.
5. A man hanging on the ropes in a helpless state, with his toes off the ground, shall be considered down.
6. No seconds or any other person to be allowed in the ring during the rounds.
7. Should the contest be stopped by any unavoidable interference, the referee to name the time and place as soon as possible for finishing the contest; so that the match must be won and lost, unless the backers of both men agree to draw the stakes.
8. The gloves to be fair-sized boxing gloves of the best quality and new.
9. Should a glove burst, or come off, it must be replaced to the referee?s satisfaction.
10. A man on one knee is considered down and if struck is entitled to the stakes.
11. That no shoes or boots with spikes or sprigs be allowed. 12. The contest in all other respects to be governed by revised London Prize Ring Rules.

Joe Escalante: This varies by state. You can always petition the court for visitation rights, but some states don?t buy into it and might say you have no standing to file. Mary Lou: We?re about to launch 1 for-profit & 2 not-for-profit web sites ? Can we/I use ?free? images from the net and/or email slides that go around? If approval required, and there is nothing on the image to note origin, how do I obtain approval to use?

Joe Escalante: This is a very sensative area. The fact that you are a non-profit has NOTHING to do with whether you can use copyrighted works without permission. The Ku Klux Klan is a non-profit organization. There are sources for pre-cleared photos on the web. Flickr.com has pictures you can license, as well as images placed in the public domain through Creative Commons or something like that. If you accidentally use an image owned by http://www.zyra.info/getstu.htm Getty, you are in trouble.

Joe Escalante: I have a 2003 Subaru I can give you a deal on.

Liz: I have an S Corp, but in 2011 I didn?t run business through it. I?m thinking of using it in 2012, but I don?t know whether it?s an advantage or just extra paperwork. Can you help me understand?

Joe Escalante: This is a question you need to sit down and discuss with your tax pro. Many states have a high minimum tax for corps on file, whether they are doing anything or not.

Maury: If I sign a document with the term ?without prejudice? does it give me recourse to dispute it in the future if I choose too and what ways can others who are required to sign the same document respond?

Joe Escalante: This is a term used in court to declare that the case is dismissed but can be refiled. With prejudice means the matter is over. In a contract it could mean a lot of things depending on the context.

Judy: Is there a time limit on when trusts must be disclosed or disbursed after a death?

Joe Escalante: Yes, but it varies by state. The beneficiary can file a claim with the probate court to get the disbursements, or remove the executor.

Amaira: My mother set up a life trust before she died on her house. My Dad is the property owner, my sister has the life trust. I am under the impression the trust was only on my Mom?s estate. Since my sister is trying to sell to sell the house without my Dad?s approval, I need to know what his legal rights are since he owns the property. Also, the property taxes on the house are not in my name, but I have been paying them. Do I have any legal rights to get what I have paid back from my family? It is in the lease from my sister that I am required to pay them.

Joe Escalante: If your dad?s name is on the title, it cannot be sold without his approval. Just paying the taxes doesn?t give you an ownership interest. If you paid the taxes and the property was otherwise abandoned by others, you could claim ?adverse possession? and file declaration of title with the county registrar but that?s rare. Can you get repaid for things you give people? Sometimes yes, sometimes no.

Beldon: Several years ago(2001) my brother died. He was from New Orleans. I hired a lawyer to handle his succession. This lawyer demanded that he be paid his fees upfront because I was not living in Louisiana so I paid him . He did not complete the succession until 2010. Because of his delays and lollygagging when Hurricane Katrina destroyed my property I could not get any aid from anyone because I was not the sole owner of the property. He delayed and foot dragged until I almost lost the property.

Joe Escalante: If you suffered damages from his incompetence you have a right to sue him for malpractice to recover the damages. And check with the laws in that state regarding payment for probate services. They are usually governed by statute, not by whether he likes money up front or not. He may have committed a state bar ethics violation.

Lisa: hi Joe ? If you get a multi-colored logo trademarked, will that trademark apply to the logo if it is used in black/white or other colors? Thanks

Joe Escalante: Yes and no, but the good news is that if anyone else uses your logo and just changes the colors, it is still likely a bold infringement. In other words, don?t get a new trademark for each color scheme you end up using down the road.

Stephanie: Hi I have a question?. I was attending a tech. School and became pregnant during the first semester. At the beginning of my second semester, ( of a 4 semester corse) the school started telling me that I couldn?t drink water in the computer room bc the water could damage the computers. They knew I was pregnant, so I brought a note from my doctors stating that I had to drink LOTS of water or I could go into preterm labor. They continued hassling me about drinking water in the computer room and telling me that if I needed to have a drink then I should step out into the hallway every time! At that time I told my doctor what they said and wrote another note stating again that I will go into preterm labor. I gave them the note again and the same thing happened. Two days later I went into preterm labor. The doctors stopped me from having my baby and put me on bed rest. I had to stop work and school. After having my daughter 4 mouths later, I tried to return to school. The school changed the program I was taking and told me I would have to take some of the classes I finished over again. Which ment, they wanted me to go to school Monday thur Friday 2 hours in the morning, 1 hour in the afternoon and 2 hours in the evening. Before all of this I was going Monday thur Thursday 7am-12pm. I can?t do the new hours plus work and take care of a new baby!
My question is? Can I do anything about this because if I don?t go back to school I will have to start paying my tuition right away for school I can?t finish. It was determined I went into preterm labor because of dehydration.

Joe Escalante: Sounds like grounds for a lawsuit to me. Talk to a plaintiff?s attorney and see if you can get anyone to take it. If not, you might have to file it yourself or cough up a bunch of money to finance it.

Lyra: What kind of attorney can handle a small claims case for $7,000.00 and garnishment of wages for that judgement????

Joe Escalante: You are not allowed to be represented by an attorney in Small Claims Court. You have to do it yourself. You can get advice from a wage and hours attorney, but they can?t appear with you.

iPad dominates due to Apple's supply deals

(AP) ? Apple certainly has lots of buzz and corporate cache behind its products, but there's a hidden ? almost mundane ? reason its newest iPad is likely to dominate the competition: the advantageous deals the company cuts with components manufacturers.

Apple's size, and the fact that the iPad shares components with the highly popular iPhone, means that the company can buy crucial parts such as processing chips and display screens at lower prices. Any company that wants to make a tablet computer that matches the iPad's $499 starting price has to endure higher costs.

As a result, Apple's tablet-making competitors have flailed ? and failed. And with the new iPad, Apple is expected to extend its 62 percent market share in the tablet computer category it created. IMS Research expects Apple to capture 70 percent of the market this year.

A year ago, scores of companies all thought they had a shot at emulating Apple's success. More than 100 tablet models were on display at the annual consumer electronics trade show in Las Vegas in January 2011. Many of them ran on the Android operating system, developed by Silicon Valley powerhouse Google.

As the year progressed, those dreams crumbled. The iPad 2, launched in March, proved nearly unassailable.

A big part of the reason was that Apple has priced the iPad aggressively. At just under $500 for the basic model, Apple's profit margin on the device is lower than on the iPhone, a smaller device for which it charges phone companies a wholesale rate of $600 or more.

On Wednesday, Apple stuck to that price point when it unveiled the new iPad model. It has a screen that displays sharper images and deeper, more vibrant colors to set it apart from the competition. The new tablet goes on sale March 16 in the U.S. and several other countries.

Apple has other advantages, too. The company sells about a third of all iPads in its own stores or from its website. By cutting out the middleman, Apple is able to keep more of the slim profit margin for itself.

Because it produces tens of millions of iPads and uses some of the same components as the highly popular iPhone, Apple can buy crucial components such as chips and displays at lower prices.

According to research firm IHS iSuppli, Apple is the world's largest buyer of the microprocessor chips that serve as the "brains" of various devices. In January 2011, Apple said it had spent $3.9 billion on long-term contracts to secure supplies for two years of a "very strategic" component it wouldn't name. Few other companies are able to commit that much money.

Many suppliers are happy to sell to Apple, given the company's success in mobile products. ARM Holdings PLC, a British chip-maker that licenses the technology used in iPhone and iPad chips, for instance, saw its stock rise nearly 4 percent Thursday, a day after Apple unveiled iPads with faster processors. Other Apple suppliers, including Cirrus Logic Inc., Jabil Circuit Inc. and Skyworks Solutions, have all experienced healthy stock gains in recent months.

The iPad's pricing created an odd situation. Usually, the first gadget of its kind to hit the market is expensive. Competition then gradually brings prices down.

With the iPad, the reverse happened: Competing products from makers such as Samsung Electronics Co. and Motorola Mobility Holdings Inc. were more expensive, at least for the first year.

The most extreme example of a tablet failure comes from Research In Motion Ltd., the maker of the BlackBerry.

In late 2010, RIM's co-CEO at the time, Jim Balsillie, said interest in the planned PlayBook tablet was "really overwhelming," particularly from corporate customers, a key market for BlackBerry phones. In March, just before it launched, Balsillie said the PlayBook "may well be the most significant development for RIM since the launch of the first BlackBerry device back in 1999."

But the PlayBook was widely panned because of its software, which RIM had put together. It was also expensive. It cost the same as an entry-level iPad 2 despite being half as big.

When sales failed to materialize, RIM had to slash the price of the PlayBook from $500 to $200. It ended up taking a pre-tax charge of $485 million for the declining value of its inventory.

Other manufacturers slashed prices too, culminating in a "fire sale" during the recent holiday season, said Rhoda Alexander, an analyst who covers tablets for IHS iSuppli.

"Those price discounts have come out of the profit margin, to a large degree," she said.

Hewlett-Packard Co., meanwhile, left the market completely. In August, it decided to discontinue the fledging TouchPad tablet along with its line of smartphones, despite great reviews for the in-house software running them.

Samsung has been one of the survivors, selling 6.1 million tablets last year, according to IHS iSuppli. That makes it the second largest tablet maker after Apple, with a market share of 9 percent compared with Apple's 62 percent. Samsung is also one of the world's leading makers of smartphones, chips and display screens. The company is, therefore, big enough to capture some of the advantages that Apple has as a buyer of components in bulk.

Samsung has put out a bevy of tablets in different screen sizes, hoping to capture buyers, who for one reason or another, want something other than the 9.7-inch screen of the iPad.

In November, another successful challenger appeared: Amazon.com Inc. The Internet retailer figured out that people would buy a device other than an iPad if the price was considerably lower. It put together a Spartan tablet with a minimum of frills and started selling it at $199. Amazon doesn't make a profit on its Kindle Fire, according to IHS iSuppli, but it hopes the device will help boost sales of movies, music and electronic books at its online store.

Analysts estimate that Amazon sold 3.9 million to 6 million Kindle Fires in the first six weeks, making it the third-largest seller of tablets last year. Looking solely at the last three months of 2011, Amazon beat Samsung as the second-largest seller of tablets.

Barnes & Noble Inc. adopted a similar strategy and was also successful, at least considering that it's a bookseller venturing into consumer electronics. It updated its Nook Color e-reader to make it more of a general-purpose device and called it the Nook Tablet. ISuppli estimates that it sold 3.3 million Nook tablets last year.

During this year's holiday shopping season, a new raft of challengers will appear: tablets powered by Microsoft Corp.'s Windows 8. Microsoft has provided software for PC-style tablets before, but they've never been more than a niche product. Now, the company is creating a version of Windows that runs on phone-style processors such as those used in the iPad. Reviews of the pre-production software have been positive. It will allow users to do some things they can't on an iPad, such as running two applications side by side on the same screen.

Still, analysts expect Apple to regain market share, after losing some because of the unsustainable discounting by competitors late last year. On Wednesday, Apple said it would keep the iPad 2 in production and cut the starting price to $399 ? the same price as Samsung's Galaxy Note Tab 10.1.
